In Florida, a Notice of Commencement May Be Required Before Your Roofing Project

A Notice of Commencement is a document that communicates the details of a significant construction project, including the anticipated start date, key participants (including the homeowner and relevant contractors), and information about the scope of the work. While not required in many states, a Notice of Commencement is a requirement here in Florida for many projects—including roofing work.

At My Florida Roofing Contractor, we provide expert roofing services and a professional, streamlined experience. Part of our role as a roofing partner is to ensure our customers are aware of necessary permitting and documentation requirements. If you’re planning a significant roofing project, chances are you’ll need a Notice of Commencement before getting started, and our team will help walk you through the process. Here’s what you should know.

Do I Need to File a Notice of Commencement in Florida for Roofing?

As a general rule, a Notice of Commencement is required in Florida for projects exceeding $2,500 in value. This encompasses many roofing projects. While minor repair projects may not exceed this amount, more significant projects—such as a roof replacement or major repair—certainly will. This means that in many cases you will first need to file this notice.

Who Should File the Notice of Commencement?

It’s the responsibility of the property owner to file the official documentation needed for a Notice of Commencement. However, as your roofing partner, our team at My Florida Roofing Contractor will not leave you in the dark.

We take our role seriously as more than just a contractor completing work on your home. We will communicate with you throughout your project to ensure you know exactly what you will need to avoid penalties for completing roofing work on your home. This means if you have any questions about the process of filing for a Notice of Commencement, our team will be happy to help out!

Requirements for a Notice of Commencement

The requirements for filing a Notice of Commencement are fairly consistent throughout Florida. However, the specifics may vary somewhat depending on your county or municipality. In general, you can expect to include any or all of the following information:

  • The street address for your property, along with a description of it
  • General information about the improvements you will be making
  • Your own personal information, including name, address, and phone number
  • Information about the contractor you will be working with, including name (personal or business), address, and phone number
  • Key dates, including the date that work is expected to begin and the expiration date of the Notice of Commencement
  • Notarization by the property owner (or an agent)

The Notice of Commencement should be filed before work begins on the project, but no more than 90 days before work begins. A Notice of Commencement is void in Florida if work does not begin within 30 days of submitting the document.

Is There a Penalty for Not Filing?

Because a Notice of Commencement is required for certain projects in Florida, if one is not filed you may be subject to legal ramifications, including financial penalties. Therefore it is important to ensure your documentation has been fully filled out and filed before work begins on your home.
